1. Who We Are
The website at vixfixpro.com (the "Site") is operated by Oryx Technologies LLC ("Oryx Tech") on behalf of VixFix Contracting and Home Improvement ("VixFix"). By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site.
These Terms govern your use of the Site only. Any home improvement work performed by VixFix is governed by a separate written contract signed by you and VixFix. Nothing on this Site is a binding offer of contracting services.
2. Acceptable Use
You may use the Site for its intended purpose: to learn about VixFix's services, browse projects and reviews, and submit a genuine inquiry for an estimate. You agree not to:
- Submit false, misleading, or fraudulent information through any form on the Site.
- Use the Site to send spam, harvest contact information, or solicit Justin Vickery or other VixFix staff for unrelated business.
- Attempt to probe, scan, or test the vulnerability of the Site or its underlying systems without prior written permission.
- Use any automated system, including bots and scrapers, to access the Site in a way that interferes with normal operation or exceeds reasonable request rates.
- Interfere with or disrupt the Site, the servers or networks that host it, or any other user's access to it.
- Use the Site in violation of any applicable law or regulation.
We may, in our sole discretion, refuse to respond to any inquiry, block any IP address, or restrict access to the Site for any user who violates these terms.
3. Intellectual Property
All content on the Site, including text, graphics, logos, photographs of completed projects, the VixFix name, and the VixFix logo, is owned by VixFix, Oryx Tech, or licensed third parties, and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written permission, other than for normal personal browsing or quoting short passages with credit and a link back to the source page.
If you submit photos, descriptions, or other content through a form on the Site, you keep ownership of that content. You grant Oryx Tech and VixFix a non-exclusive, royalty-free, worldwide license to use that content for the limited purpose of preparing and providing an estimate, performing the requested work, internal recordkeeping, and, with your separate prior consent, in case studies or marketing materials. You can revoke that license for future marketing use at any time by emailing us at the addresses listed in section 9.
4. Quote and Estimate Requests
Submitting an estimate request or contact form is not a contract. We will use the information you provide to follow up about a free estimate. A binding contract for services is created only after VixFix prepares a written estimate, you accept the estimate, and both parties sign a written contract. Pricing and scope on the Site are general and subject to change.
5. Disclaimer of Warranty (Website)
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Oryx Tech and VixFix disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation. We do not warrant that the Site will be available without interruption, free of errors, or free of harmful components.
This disclaimer applies only to the Site. The quality and performance of any contracting work performed by VixFix is governed by the warranty terms in the signed contract for that work, not by these Terms.
6. Limitation of Liability (Website)
To the maximum extent permitted by applicable law, Oryx Tech and VixFix will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, including loss of profits, loss of data, business interruption, or loss of goodwill, even if advised of the possibility of those damages. Our total cumulative liability arising out of or related to your use of the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
7. Third-Party Links
The Site may contain links to third-party websites, including our Facebook page, brand manufacturers, and external resources. We do not control those sites and are not responsible for their content, policies, or practices. Following a link is at your own risk.
8. Governing Law and Disputes
These Terms are governed by the laws of the State of New Hampshire, USA, without regard to its conflict-of-law principles. You agree that the exclusive venue for any dispute arising out of or related to these Terms or your use of the Site is the state or federal courts located in Merrimack County, New Hampshire, and you submit to the personal jurisdiction of those courts.

10. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified only as much as necessary to make it enforceable while preserving its intent. These Terms, together with the Privacy Policy, are the entire agreement between you and Oryx Tech and VixFix regarding your use of the Site, and supersede any prior agreements between us on that subject.
11. Changes
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.
